Privacy policy regarding the processing of personal data

Caleffi S.p.A. Caleffi S.p.A. provides you with this information regarding the processing of personal data of Users consulting the website www.caleffionline.com (the "Website") pursuant to Article 13 of EU Regulation no. 679/2016 on the protection of personal data (the "Regulation").

This information is provided only for the Site and not for other websites that may be consulted by the User through links.

Please note that the Site makes use of COOKIES as better specified in the relevant cookie policy at the end of this statement.

 

Data Controller

The personal data relating to the User that Caleffi collects and processes through the User's access to the Website are those data that the User has freely and spontaneously provided for the purposes indicated below.

This data concerns: name, surname, date of birth, sex, home address, shipping address, home telephone number, mobile phone number and personal email address ("Personal data").

Caleffi also informs you that the computer systems and software procedures used to operate the Website acquire, during their normal operation, certain data whose transmission is implicit in the use of Internet communication protocols. This information is not collected in order to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, make it possible to identify Users. This category of data includes the IP addresses or domain names of the computers used by Users who connect to the site, the URI (Uniform Resource Identifier) notation addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the User's operating system and IT environment. This data is used for the sole purpose of obtaining anonymous statistical information on the use of the Site and to check its correct functioning.

Caleffi also informs you that the data relating to the credit card (card number, holder, expiry date, security codes) that will be requested from the User to make an online purchase of the products on sale on the Site will be acquired by the payment service provider who will act as the autonomous Data Controller. This data will be acquired in encrypted format and in compliance with the security requirements set out in industry certifications. Caleffi will only keep track of the last four digits of the credit card number and its expiry date, as well as the log files and IP addresses used during the finalisation of the purchase, in order to prevent and ascertain possible frauds in online transactions.

Your Personal Data will be processed, as the case may be, for the following purposes:

  1. Website registration;

  2. conclusion, execution and operational management of the contract of sale of goods through the Site, as well as for the purposes strictly connected, related, derived and instrumental to the sale (e.g. selection of products, sending of orders and their acceptance, delivery and possible exercise of the right of withdrawal and consequent withdrawal of the goods, as well as any other fulfilment provided for in the terms of sale);

  3. fiscal and administrative-accounting;

  4. sending email communications aimed at promoting the sale of products similar to those already purchased by the User, without prejudice to the User's right to object at any time;

  5. subscription to the commercial Newsletter containing marketing communications, news, information and updates on products and services, offers, discount coupons, promotions and special events by Caleffi;

  6. sending - by postal service or by text message, email, telemarketing and the like - other commercial/marketing communications relating to products marketed by Caleffi and, specifically, offers, news, discount coupons, promotions and special events;

  7. analysis of the User's preferences and consumption habits and processing of the User's personal preferences and interests by means of automated tools and the transmission of personalised offers through the Site;

  8. replying to any communication sent to the Controller, including through the Site, or by email or telephone line, to report problems and/or to forward requests (including requests for assistance) or comments on products

When Personal Data are collected for the above-mentioned purposes, specific information will be provided in the relevant sections of the Site, pursuant to Article 13 of the Regulation, and the relevant processing consents will be requested where required.

The provision (and related processing) of Personal Data:

  • is necessary for the purposes set out in paragraph 2 (i), (ii) and (iii), in order to allow the Company to comply with the User's request for registration to the Site and to fulfil its contractual and/or legal obligations. Therefore, failure to provide such information would make it impossible for you to navigate in the reserved areas of the Site, to proceed with the purchase of the desired products, to obtain delivery, the eventual return of the products as well as any other fulfilment foreseen in the conditions of sale;;

  • is optional for the purposes set out in paragraph 2 (iv), it being understood that the relevant processing does not require your prior consent, given the legitimate interest of the Controller in sending email communications aimed at promoting the sale of products similar to those you have already purchased on the Site. However, if you refuse the use of your Personal Data - by exercising your right to opt-out - for the forwarding of such future communications, this will have no effect on your ability to proceed with the purchase of the desired products, but it will prevent you from receiving information and/or commercial communications relating to Caleffi products similar to those you have already purchased;

  • is optional for the purposes set out in paragraphs 2 (v), (vi) and (vii) and the relevant processing is only allowed with your prior consent. Failure to provide Personal Data (and related processing) for these purposes will have no effect on your ability to proceed with the purchase of the products you desire, but will prevent you from receiving the commercial newsletter and other commercial/marketing communications, possibly personalised, relating to Caleffi and Caleffi products;

  • is necessary for the purposes set out in paragraph 2 (viii), in order to allow the Company to respond to the communications and/or requests received. Therefore, failure to provide (and process) Personal Data for said purposes would make it impossible for the Data Controller to provide replies to the communications and/or requests sent by you.

It should be noted, therefore, that any processing of Personal Data takes place on the basis of a lawful 'justification' (or legal basis) for the processing. In particular, the processing of Personal Data is justified on the basis of one or more of the following assumptions::

  • the processing is necessary for the fulfilment of a contract/agreement with the User or to carry out activities requested by the User;

  • processing is based on the legitimate interest of the Controller;

  • processing is based on the prior express consent of the User.

  1. Processing methods and storage period

The processing of Personal Data is carried out by means of the operations indicated in Art. 4 no. 2 of the Regulation, namely: collection, recording, organisation, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data.

Personal Data shall be processed, with the support of telematic, computerized and/or paper means, limited to the purposes set out above and in such a way as to guarantee their security and confidentiality and to prevent their loss, illicit or incorrect use and unauthorized access.

Personal Data will be processed:

  • with reference to paragraph 2 (i), until you delete your Account profile from the Site;

  • with reference to Paragraphs 2(ii) and (iii), for the time necessary to perform the contractual relationship and for the performance of legal and administrative-accounting obligations incumbent on the Controller for a maximum period of 10 years from the termination of the relationship

  • with reference to Section 2 (iv), until you exercise your right to opt out in the manner provided for in Section 8 below;

  • with reference to paragraphs 2 (v) and (vi), for a maximum period of 24 months;

  • with reference to paragraph 2 (vii), for a maximum period of 12 months;

  • with reference to paragraph 2 (viii), for as long as is strictly necessary to achieve the purposes for which they were collected.

In any case, the statute of limitations established for the rights and obligations underlying the processing carried out will be respected.

Please note that, in any event, your Personal Data will be processed by the Data Controller's staff duly appointed and instructed by the Data Controller.

  1. Recipients of personal data

Personal Data may be disclosed, strictly in relation to and consistent with the purposes set out above, to the following categories of persons:

  • companies belonging to the Caleffi Group for the purposes set out in paragraph 2 (ii) and, in particular, to guarantee adequate support to the User on products bearing trademarks owned by other companies belonging to the Caleffi Group; failure to provide such information may make it impossible to fulfil contractual and/or legal obligations;

  • third parties for any activities carried out in outsourcing on behalf of the Controller, including, in particular

    • transport/shipping services

    • mailing services, also aimed at notifying the User of order progress or sending commercial communications/marketing;

    • data analysis services;

    • services for the application management of the Site;

  • banks and credit institutions;

  •  

    supervisory authorities.

The subjects belonging to the above categories operate in total autonomy, as autonomous data controllers, or as responsible subjects carrying out activities in the interest of the Data Controller.   1. Transfer of personal data to a third country or international organisation 

The Data Controller does not intend to transfer Personal Data to countries outside the European Union.

It is understood, in any case, that the Data Controller - should it become necessary (essentially in consideration of the location of the servers of the third parties called to perform, on behalf of the Data Controller, outsourcing services as set out in paragraph 4 of this information notice) - will be entitled to transfer your Personal Data also outside the EU. In this case, the Data Controller assures, as of now, that the transfer will take place in compliance with the applicable legal provisions, subject to the adoption of the standard contractual clauses as issued by the European Commission.

  1. Rights of the data subject

The User - as Data Subject - may exercise the following rights vis-à-vis the Data Controller at any time, where applicable: 

Right of access:

obtain confirmation as to whether or not personal data relating to him or her are being processed and, if so, the right to obtain, inter alia, access to those data and to information concerning the purposes of the processing, the categories of personal data concerned and the recipients or categories of recipients to whom the data have been or will be disclosed.

Right of rectification:

(Art. 16 of the Regulation)

((i) obtain the rectification of inaccurate personal data concerning him/her without undue delay and (ii) the integration of personal data, if incomplete.

Right to erasure ('right to be forgotten')

(Art. 17 of the Regulation)

obtain the deletion of personal data concerning him/her without undue delay (the Data Controller is obliged to delete personal data without undue delay in the cases provided for in Article 17 of the Regulation).

Right of restriction of processing:

(Art. 18 of the Regulation)

object, at any time: (i) on grounds relating to his or her particular situation, to the processing of personal data relating to him or her in accordance with Article 6(1)(e) or (f), including profiling on the basis of those provisions and (ii) if his or her data are processed for direct marketing purposes, including profiling insofar as related to such direct marketing.

You will also have the right to withdraw your consent at any time, where it has been given in accordance with this notice. Withdrawal of consent to processing shall not affect the lawfulness of processing carried out on the basis of the consent previously given.

Finally, it should be noted that the data subject has the right to lodge a complaint with the Garante per la Protezione dei dati personali (Data Protection Authority) if he/she considers that the processing concerning him/her violates the requirements of EU Regulation No. 679/2016
